Member Terms and Conditions

Member enrolls in the NannyNurse™ Network in order to access NannyNurses™ to care for Member’s sick child in the Member’s home and agrees to pay the NannyNurse personally and directly on-site daily for services rendered according to the effective Child Care Fee Schedule published by the Network.

The Network is managed by Nanny Nurse Network, LLC (the “Company”) and is designed to provide access to in home sick child care and does not provide healthcare, nursing or medical care. Member understands and agrees that services by a NannyNurse are not a replacement for the attention of a doctor or hospital and NannyNurses do not provide medical advice. Services are not covered by insurance.

Member agrees to provide accurate and complete information to the Network regarding details of the services requested, the child’s condition, and instructions from the doctor and/or pharmacist for the child, including all information for enrollment into the Network and details required for the Wellness Log. Member agrees to keep all contact information up to date in Member’s Network enrollment.

The Company has created procedures to screen individuals and designates a Code of Conduct together with Guidelines & Policies for NannyNurses to follow before, during and after their assignments to encourage reliable child care services. However, Member accepts responsibility for the selection of the NannyNurse entrusted with Member’s child and releases the Company, its owners, managers, employees and agents for any and all claims relating to the conduct of the NannyNurse.

There are three kinds of standard fees for use of the Network. Member’s enrollment in the Network is subject to both a nonrefundable Annual Enrollment Fee and a Placement Fee for each NannyNurse assignment. The amounts of these fees and conditions of enrollment are published on the Company website and are payable by credit or debit card to the Company. Payments for hourly services rendered are made by Member to the NannyNurse in accordance with the Child Care Fee Schedule published by the Company.

Member understands that NannyNurses are not employees of the Company and are not insured by the Company. Member may be responsible for withholding or filing employment taxes or issuing a tax reporting form (e.g. Form 1099) to a NannyNurse if payments for services exceed limits set by the Internal Revenue Service during any calendar year.

Member agrees not to refer a NannyNurse to a third party except through the Network and agrees to pay the Company a charge of $500 in liquidated damages for each occurrence and a forfeit of Member’s membership without refund. Member understands that NannyNurse’s agreement with the Company would be jeopardized by any communications which invite NannyNurse to provide services “Out of Network” to Member or any other person. Member agrees not to seek services of any kind from a NannyNurse outside the Network from the date Member enrolls in the Network plus 18 months. Such period shall be extended by the duration of any subsequent Network enrollment by the Member.

Member agrees to provide a reasonably safe home environment for Member’s child and the NannyNurse and to insure any injury or loss occurring at Member’s home. In case of an emergency, Member agrees to come home or go to the hospital designated promptly upon a call from NannyNurse who will call 911 first upon a condition deemed urgent. Children will not be transported by a NannyNurse to a medical facility. Member accepts full responsibility for all medical care (including the cost of an ambulance) and holds harmless and releases Company and NannyNurse entirely for such expenses.

Member agrees to protect Member’s password and/or login information as confidential and exclusively for Member’s use and agrees not to use the Network for any purpose other than the purpose for which it was designed. Member further agrees not to upload or post any information to the website in bad faith, in violation of the rights of any person, or which is designed to interfere with the operation of the Network. The Company reserves the right to terminate Member’s enrollment in the Network for the breach of this provision or any other term of this Agreement.

Member understands that in order for Member to access child care givers, information regarding Member (and Member’s child) must be accessible to the NannyNurses enrolled in the Network. Member holds harmless and releases Company from any undesired use of this information by a NannyNurse.

Company cannot and does not guarantee the uninterrupted error-free operation of the Network, the credentials published by a particular participating NannyNurse or the availability of a NannyNurse for a placement. Any questions or comments regarding the NannyNurse Network shall be directed to the Company. NannyNurse is not an agent of Company and is not authorized to address technical issues, enrollment issues or service or financial policies established by the Company. Member is encouraged to participate in the Satisfaction Survey upon completion of each assignment.
